Terms of Service

By starting to use the services of RiShimaDive, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree to these Terms of Service, you may not use RiShimaDive’s services.

1. Your Relationship with RiShimaDive
1.1 These Terms of Service govern your use of the “RiShimaDive platform” (.rezio.shop) and any other online or offline services we provide, as well as your tourism-related transactions made through RiShimaDive (collectively, the “RiShimaDive Services”).
1.2 These Terms constitute a binding agreement between you and RiShimaDive. By using the RiShimaDive Services, you agree to comply with any additional terms related to the services, including updated versions from time to time, and RiShimaDive’s Privacy Policy, all of which are incorporated by reference into these Terms.
1.3 RiShimaDive may modify or update these Terms at any time without prior notice if required by applicable laws or if deemed necessary. When changes occur, the latest version will be published on our website (.rezio.shop) with an updated revision date. Your continued use of the RiShimaDive Services after changes constitutes your acceptance of the updated Terms. Please review the Terms regularly.

2. RiShimaDive Services
2.1 RiShimaDive provides a platform for you to easily browse and purchase travel itineraries, transfers, tickets, and other travel experiences offered by RiShimaDive or third-party suppliers (“Suppliers”). You agree these services are for personal use only and not for commercial purposes. Within the maximum extent permitted by law, RiShimaDive reserves the right to modify, suspend, or terminate any service or impose restrictions or changes to individual services without prior notice.
2.2 You may be required to pay fees directly to Suppliers for the services booked, and you agree to abide by the Suppliers’ terms. You accept full responsibility for these payments.
2.3 While we strive to maintain continuous operation of the RiShimaDive Services and platform, we do not guarantee uninterrupted or error-free access. We reserve the right to refuse access, modify, suspend, interrupt, or terminate the Services or platform at our discretion.

3. Platform Content
3.1 “Platform Content” means all materials presented or used on the RiShimaDive platform, including but not limited to text, photos, images, illustrations, videos, audio, data, code, and other materials. All such content is the exclusive property of RiShimaDive or its licensors and protected by intellectual property laws. RiShimaDive may change, modify, or remove any content at any time without prior notice.
3.2 Subject to your compliance with these Terms, RiShimaDive grants you a limited, non-exclusive, non-transferable license to access and use the platform. This license may be revoked at any time without notice. You agree to use Platform Content only for personal, non-commercial, and entertainment purposes, and you will not copy, reproduce, translate, transmit, distribute, sell, sublicense, create derivative works, or otherwise use the content in any unauthorized way. You also agree that you use the content at your own risk, and RiShimaDive disclaims liability for any errors or omissions. You will bear all responsibility for damages caused by your use of Platform Content.
3.3 You acknowledge that interactions with other users on the platform may be unpredictable, and we do not guarantee the truthfulness or accuracy of third-party content.

4. Information You Provide
4.1 You consent to our use of your personal data in accordance with the RiShimaDive Privacy Policy.
4.2 You agree to receive invitations to provide traveler reviews via SMS, email, or platform notifications, and may choose whether to submit them. Submitted reviews may be published on the platform at our discretion. Reviews must not be misleading, defamatory, threatening, abusive, or contain personal data of others or illegal content.
4.3 By submitting reviews (including text, photos, videos), you grant RiShimaDive and Suppliers a perpetual, worldwide, royalty-free, sublicensable, non-exclusive license to use, reproduce, adapt, translate, create derivative works, and promote the content through any media. Users of the platform may also access and use reviews for non-commercial purposes. Your ownership rights in your submissions remain unless otherwise agreed in writing.
4.4 You warrant that your submissions do not violate any laws or third-party rights, and you accept full responsibility. RiShimaDive is not liable for any errors or omissions.
4.5 We reserve the right to remove any content you provide at our sole discretion.

5. Your Commitments
5.1 You will only use RiShimaDive Services and platform in compliance with these Terms and bear sole legal responsibility for your actions.
5.2 You agree not to:
(a) Copy, reproduce, distribute, publicly display or transmit any part of the Services without prior written consent, including altering or circumventing any software or using trademarks or content belonging to RiShimaDive;
(b) Circumvent or interfere with security measures or extract content in violation of personal use limits;
(c) Reverse engineer, decompile, hack, or attempt unauthorized access to the Services or their components;
(d) Use framing or other technologies to present or mimic RiShimaDive Services without permission;
(e) Access or damage non-public areas of the platform or related computer systems;
(f) Harass or abuse other individuals or employees;
(g) Provide false personal information or impersonate others;
(h) Collect personal data of other users without consent;
(i) Restrict others’ use of the platform or disclose others’ personal information without consent;
(j) Use the platform for commercial advertising or data gathering unless expressly permitted;
(k) Engage in fraud, password cracking, data theft, or other illegal activities.

6. Order Confirmation and Refund Policy
6.1 You may purchase travel services using designated currencies via the platform. Some orders are confirmed instantly; others require confirmation from RiShimaDive or Suppliers. You agree to receive booking notifications via SMS, email, or app. Timing indicated is for reference only.
6.2 RiShimaDive reserves the right to change prices or fees of services and will notify via SMS, email, or website. Continued use after notice implies acceptance.
6.3 RiShimaDive may refuse or cancel bookings violating these Terms at its discretion.
6.4 Payment must follow accepted methods. Orders are not processed until payment completes. Except where stated, payments are non-refundable.
6.5 If services are provided by Suppliers, they solely accept or reject bookings and provide services. Questions should first be directed to Suppliers; RiShimaDive may assist communication.
6.6 Additional taxes or fees may apply payable directly to Suppliers or tax authorities. While we seek to provide accurate information, we do not guarantee all displayed content is error-free. If a Supplier cancels an order, RiShimaDive will notify you promptly.
6.7 Refunds for cancellations made within stated deadlines will be processed using the original payment method, subject to exchange rate fluctuations and processing fees.
6.8 Electronic Voucher Use:
6.8.1 After booking, you will receive an electronic voucher via SMS or email for printing and use unless physical tickets apply.
6.8.2 You must comply with any additional conditions set by RiShimaDive or Suppliers, such as appearing on time at designated locations with required documents. Failure may result in denied service or no refund.
6.8.3 Lost or stolen vouchers are not reissued. Fraudulent use may be refused without refund.

7. Limitation of Liability
7.1 Platform Content may be provided by Suppliers. RiShimaDive disclaims all warranties regarding accuracy and is not liable for Supplier content.
7.2 Communications via the platform are not confidential and may be intercepted. No fiduciary or trust relationship is established between you and RiShimaDive.
7.3 To the fullest extent permitted by law, RiShimaDive and its affiliates are not liable for any direct, indirect, incidental, punitive, or consequential damages related to the use of the platform or violation of these Terms.
7.4 If liability is established, your sole remedy is to stop using the Services. Damages are limited to the total fees you paid in the prior 12 months.

8. Indemnification
8.1 You agree to indemnify and hold harmless RiShimaDive, its officers, employees, and agents against claims arising from your violation of these Terms or infringement of others’ rights.
8.2 RiShimaDive may require you to defend or settle claims but you may not enter agreements adversely affecting RiShimaDive without prior written consent.

9. Termination
9.1 We may suspend or terminate your access without notice if you violate these Terms or as deemed necessary.
9.2 Upon termination, RiShimaDive has no obligations to you and may cancel your pending orders without refund.
9.3 Provisions intended to survive termination will remain in effect.

10. Visa and Insurance
10.1 You are responsible for understanding and complying with the current entry requirements of your travel destinations.
10.2 We recommend purchasing comprehensive travel insurance before departure.

11. Dispute Resolution
Disputes arising from use of the Services shall be subject to the jurisdiction of the courts in the location of RiShimaDive’s business operations.

12. Miscellaneous
12.1 If any provision is held invalid or unenforceable, remaining provisions remain in full effect.
12.2 We may assign rights and delegate obligations under these Terms. You may not transfer your rights or obligations without prior written consent.
